2.General Conditions of Use for this Website
By accessing this web page, you are considered to be the “User”, implying at the time of access that you expressly accept the general conditions that are published on www.ngs.eu with no reserves. Therefore, the User must read these general conditions of use every time he accesses and uses the services provided on the website as these are subject to modifications. Accordingly, “User” is understood to be the person who accesses, navigates, uses or participates in the free or paid services and activities provided on www.ngs.eu .
2.1. Objective and Area of Application
These general use conditions regulate access, navigation and use of www.ngs.eu and the responsibilities derived from using its contents including text, graphics, drawings, designs, code, software, photographs, music, videos, sounds, databases, images, expressions and information as well as any other creation, which is protected by national laws and international treaties having to do with intellectual and industrial property.
Lurbe Grup, S.A. (hereinafter NGS) shall be able to establish particular conditions applicable to using and/or contracting specific services, in which case the present general conditions would be considered supplementary.
2.2. Conditions for Accessing and Using the Services
a) General access to www.ngs.eu is provided free of charge. However, some of the services and contents may require that the service or product is contracted in advance. In such cases the particular conditions created for said purpose will be provided by NGS before celebrating the contract.
b) Minors that use the services on this website must have the prior consent of their parents, guardians or legal representatives, who will be solely responsible for the actions of minors under their authority.
c) At all times, the User must make lawful use of this website’s services in accordance with these general conditions, current legislation, good morals, public order and generally accepted Internet practices.
d) The User guarantees that information provided through registration forms on this website is lawful, real, exact, true and up-to-date. It is the User’s sole responsibility to immediately communicate any modification that may be maid to the information provided to NGS.
e) The user shall abstain from: introducing viruses, programmes, macros or any other sequence of characters with the purpose of damaging or altering this websites computer systems; creating an obstacle for access by other users due to the massive consumption of resources; collecting data from this website for the sake of publishing it; reproducing, copying, distributing, transforming or making the contents included on this website available to third parties; using the services on this website to engage in actions that could harm the intellectual property, industrial secrets, contractual agreements, honorary rights, the image and the personal intimacy of third parties; engaging in unfair competition and illegal advertising.
f) If using and/or contracting a service on www.ngs.eu requires the User to register, it is said User’s responsibility to provide true and legal information. If the User is granted a password upon registration, he commits to use it diligently for accessing these services and to keep it secret. Consequently, Users are responsible for the appropriate custody and confidentiality of any identifiers and/or passwords provided them, and they commit neither to cede use to third parties, whether temporary or permanent, nor to permit access to strangers. Unlawful use of these services by any illegitimate third party, gaining access through a password due to the User’s carelessness or loss of the same, will be the User’s responsibility In cases of burglary, loss or unauthorised access to his passwords, the User will be responsible for immediately notifying NGS in order to cancel them. In no way will NGS be responsible for the actions of unauthorised third parties as long as the aforementioned notification has not been provided by the User.
RETURN POLICY
If you are not satisfied, you can return your purchases on www.ngs.eu . Only the purchases made on www.ngs.eu will be accepted.
The maximum refund term is 15 calendar days from the reception order.
The reasons that may cause an item return are the following:
If you are not satisfied with your purchase:
-It can be returned by courier service to Portuetxe 27, 20018 San Sebastián (Guipúzcoa) and we will reimburse the money except the shipping fees paid for the order.
-In case of being a gift:
-The product can be exchanged if it has not been unsealed and it is in perfect conditions. The money spent in the purchase will reimbursed to the person who bought it.
Refund policy:
In order to exchange a product you have to contact our Technical Assistance Service by sending an e-mail to: support@ngs.eu
The refund will be made through the method of payment used for the purchase.
IMPORTANT:
NGS doesn´t refund the purchase or won´t do any mercancy resent while it hasn´t been verified the reception and packaging and product accessories state in our warehouse.
The refund cost is the one that figured in the order.
WARRANTY:
All NGS Products bought through our online store have 3 years warranty (depending on the product), always from the purchase date of the bill. Therefore the replacement or repair of the product doesn’t extend the initial warranty period.
* Batteries are excluded from this warranty, having a warranty period of 12 months*
IMPORTANT:
No refund nor any exchange will be made by ngsonline.ngs.eu until the reception and the packaging have been checked and the item has been received to our warehouse.
The price to be refund is the one that appeared on the order, except the shipping fee that will be refund in case of ngsonline.ngs.eu being liable of the cause of the product exchange.
3. Intellectual and Industrial Property Rights
NGS is the owner of the intellectual and industrial property rights of every component comprising www.ngs.eu, including the brand, trade name and distinctive symbol. Particularly and of unlimited ownership, the copyright, graphic design, source code, logos, text, graphics, illustrations, photographs, sounds and other components comprising the website are protected.
In no case does access to or navigation on www.ngs.eu imply the partial or complete renouncing, transmitting or licensing to the User for personal use of NGS’s intellectual and industrial property rights.
Accordingly, the User recognises that reproducing, copying, distributing, marketing, altering, reusing, publicly communicating and in general exploiting the contents of www.ngs.eu in any other way by any method without express permission provided in writing by NGS, is considered a violation of NGS's intellectual and industrial property rights. All data, which is not considered to be personal information, transmitted voluntarily to www.ngs.eu over the Internet (including any observation, suggestion, idea, graphic, etc.) will become the exclusive property of NGS which will hold the unlimited rights of use without paying you or any other person for said rights.
4. System of Responsibilities and Guarantees
4.1. NGS does not guarantee reliability, usefulness, truthfulness or accuracy of the information provided on www.ngs.eu, therefore, indemnifying it from any direct or indirect responsibility for damages or losses, whatsoever the nature, derived from fraudulent use of or expectations deposited in the same by the User.
4.2. NGS declares that it has adopted the technical and organisational measures, within its range of possibilities and the state of technology, enabling the correct operation of the website and seeking the absence of viruses and damaging components. Nonetheless, it cannot be responsible for:
(a) the continuity and availability of contents and services provided on www.ngs.eu;
(b) the absence of errors in said contents or the correction of any defect that could occur;
(c) the absence of viruses and/or other damaging components on www.ngs.eu ;
(d) the impenetrability of security measures adopted; (e) the damages or losses caused to any person who is wounded due to the security of www.ngs.eu .
4.3. The User will be solely responsible before third parties, for any communication or information sent personally or in his name to www.ngs.eu and will be responsible for unlawful use of the contents and services on this website.
4.4. NGS reserves the right to suspend access to www.ngs.eu , temporarily and without prior warning, for reasons of maintenance, repair, update or improvements. As long as circumstances permit, NGS will publish a notice reasonably in advance on its website indicating the date when services are planned to be suspended.
4.5. When links to other web pages are posted on www.ngs.eu , they direct you to websites for which NGS assumes no responsibility, because it does not have any control over these websites. The purpose of such links is to inform the user of other information sources, and the User can access the contents under his own responsibility and according to the conditions of use of said web page.
4.6. NGS does not accept responsibility for the use that Users can make of the contents and services included on its website. Consequently, it does not guarantee that the use, which the Users can make of the referenced contents and services, will meet these general conditions of use nor that they will diligently use the contents and services.
GENERAL USE CONDITIONS
Lurbe Grup, S.A. saves himself(herself) the right to request invoice of those products which coupons it is necessary to verify for considering them to be an object of possible fraud.
For this motive, it will be indispensable that the client facilitates the above mentioned document before realizing the sending(parcel) of order(request).
Likewise, Lurbe Grup, S.A. saves himself(herself) the right to block any user whose behavior in the CLUB NGS is considered to be fraudulent.
The physical coupons that they find inside the packaging product NGS, will never have to be exchanged in the zone of the CLUB enabled for it, only for FINAL USER, for DISTRIBUTORS since, already they have a special rate(price list) on having acquired the above mentioned products.
5. Duration and Modification
5.1. NGS reserves the right to modify, in part or in full, these general access conditions, publishing the changes on www.ngs.eu. Likewise and without prior notice, it shall be able to make modifications to the website that it considers appropriate, being able to change, remove or add the contents and services provided as well as the way these are presented and positioned. Consequently, the general conditions published when the User accesses www.ngs.eu shall be considered current. Therefore, the User should periodically read said conditions of use.
5.2. Independently of the provisions in the particular conditions, NGS shall be able to terminate, suspend or interrupt access to the page contents at any time, without prior notice and such that the User has no right to demand indemnification whatsoever.
6. Applicable Legislation and Competent Jurisdiction
Relations established between NGS and the User shall be governed by the provisions in the current regulations with regards to applicable legislation and Competent Jurisdiction. Nonetheless, for those cases in which the regulation foresees the possibility for the parties to submit themselves to a venue, NGS and the User expressly renounce any other jurisdiction or venue that could apply to them and submit to the Courts of Law in the City of San Sebastián.
